Limitation of Liability
NOTE: Sports are an inherently dangerous activity, and injuries are a possible result.All players, participants, coaches, parents and other individuals should use caution in engaging in and training for sporting activities.Not all of the drills, services, and information available through the Drillbook.com or its related websites are appropriate for all levels of players, or in all circumstances, and some of the training methods and other information available will carry a risk of serious injury or death.It is the responsibility of the players, coaches, organizers, and parents to ensure that any activity is carried out in a safe manner, including taking all appropriate steps to ensure that participants are wearing the proper protective equipment.The Drillbook.com Inc. disclaims any warranty, whether express or implied, with respect to the services and information provided.
In no event will the Drillbook.com Inc., or its owners, partners, employees, affiliates, successors, subcontractors, or agents, be liable to the users, team participants, or any other party, for direct, indirect, general, special, incidental, consequential, exemplary or other damages, including without limiting the generality of the foregoing, damages as a result of injury, loss of use, loss of future income, medical care, pain and suffering, or lost profits, arising out of the use of any of the services or the information provided by the Drillbook.com Inc.All users expressly agree, on behalf of themselves, their minor children, and any other persons over whom they have guardianship, or otherwise have the legal right to enter in to agreements, that the use of the services and information provided by the Drillbook.com Inc. will be expressly at the risk of the users, including without limitation: coaches, players, and parents; and by accessing the services and information provided, each party expressly agrees to indemnify and hold harmless the Drillbook.com Inc., its owners, employees, affiliates, successors, subcontractors, and agents from any damages, dues, sums, costs, or claims, whether direct or indirect, at law or at equity, that may be result from the use of the services and information available through the Drillbook.com, or any of its related websites.
By using the services provided by the Drillbook.com, youfurther expressly agree, on behalf of yourself, your minor children, and any other persons over whom you have guardianship, or otherwise have the legal right to enter in to agreements, that the Drillbook.com, its owners, employees, affiliates, successors, subcontractors, and agents shall not be liable for any damages, or any kind whatsoever, whether at law or at equity, direct or indirect, which may result from an inability to access the information or services provided by the Drillbook.com at any given time, or from any breach of warranty or conditions.
These provisions shall survive termination of this agreement.
